Single User License

Single user license is non-transferable and allows the purchaser to access the training content for a single user. Duplication, sharing, multiple installations, and/or electronic transmission of any content are a violation of Total Seminars and International conventions copyright.

Total Seminars, LLC Rights

It is hereby understood, acknowledged, and agreed by the purchaser that:

(i) Total Seminars, LLC and/or its suppliers, agents, and contractors, as applicable, is/are the exclusive owner(s) of all rights, title and interest in and to the online training content, program, and documentation, and interest includes, but is not limited to, the rights provided by patent, copyright, trademark, trade secret, and trade dress laws, both domestic and international;

(ii) Notwithstanding any other provision of this agreement, Total Seminars, LLC and/or its suppliers, agents, and contractors, as applicable, owns and retains all right, title, and interest in and to the online training content. You do not, by virtue of Your purchase and/or use of the training, program and/or documentation, as applicable, thereby acquire any ownership, rights, title, or interest, of any kind in the system, program, or documentation.


In consideration of the payment of a license fee, Total Seminars, LLC hereby grants to You a nonexclusive license to access the training content, program and documentation and to use the content, program, and documentation solely for computer systems certification eLearning in accordance with the terms of this agreement. Your access to these online materials will expire 1 year after the book goes out of print. Your license to access the online materials will run for the specific term defined whether or not the online materials are used. Your obligations under this Agreement will exist until said term expires or the access is terminated by McGraw-Hill or Total Seminars.

Restrictions on your Use

Your use of the training content, program, and documentation shall, in all cases, be restricted as follows:

(i) You shall use the training content, program, and documentation only for Your computer systems certification eLearning, and You shall take all reasonable steps to protect the training, program, and documentation from any copying and/or use;

(ii) You shall not, without Total Seminars' prior express written consent reproduce or otherwise copy, or cause or permit the reproduction or copying of, the training content, program, or documentation in any way, shape or form, or modify the training content, program, or documentation, and/or merge them with any another software;

(iii) In no event shall you make, or attempt to or permit the making of, any improvements, modifications, or amendments to the training, program, and/or documentation;

(iv) You may not disassemble the program or documentation into smaller parts or learning objects, and You may not copy the training content, program or documentation to any media, disk drive, network server, CD-ROM, or other machine-readable media, for distribution. Notwithstanding anything to the contrary herein, You shall not, nor shall You aid or permit any third party to, modify, reverse engineer, reproduce, decompile or disassemble the program, or otherwise attempt to create the source code from the program;

(v) You shall not modify, adapt, or create derivative works based on the training content, program, or documentation;

(vi) You shall not use, nor cause or permit to be used, the training content, program, or documentation in any manner that infringes Total Seminars' rights or the rights of any third party;

(vii) You shall not distribute, nor cause or permit to be distributed, the training content, program, or documentation, or derivatives thereof; and

(viii) You shall not electronically transfer the training content, program, or documentation through a local area network, wide area network, or any other computer network system, or through any computer subscriber system, bulletin-board system, or other system of comparable functionality.

Restrictions on Transfer

You shall not sell, rent, lease, sublicense, assign, transfer, network, reproduce, or timeshare the system, program, documentation, or Your rights, duties, or obligations under this agreement, nor cause or permit any third party to do the same. Further, any such sublicense, assignment, or other transfer of any of Your rights, duties, or obligations hereunder is void ab initio (from the beginning).

Limited Warranty

Total Seminars warrants that the files containing the training content are free from defects in the operational sense that they can be accessed via the Internet using a browser. EXCEPT FOR THIS EXPRESS LIMITED WARRANTY, TOTAL SEMINARS MAKES AND YOU RECEIVE NO WARRANTIES, EXPRESS, IMPLIED, STATUTORY OR IN ANY COMMUNICATION WITH YOU AND TOTAL SEMINARS SPECIFICALLY DISCLAIMS ANY OTHER WARRANTY INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS OR A PARTICULAR PURPOSE. TOTAL SEMINARS DOES NOT WARRANT THAT THE OPERATION OF THE VIDEO TRAINING WILL BE UNINTERRUPTED OR ERROR FREE. If the training were purchased in the United States, the above exclusions may not apply to you as some states do not allow the exclusion of implied warranties. In addition to the above warranty rights, you may also have other rights that vary from state to state.

Limitation of Liability



This Agreement constitutes the entire agreement between you and Total Seminars and supersedes any prior agreement concerning the training. This Agreement is governed by the laws of the State of Texas without reference to conflicts of law provisions.

Neither McGraw Hill nor its licensors shall be liable to any subscriber or to any user or anyone else for any inaccuracy, delay, interruption in service, error or omission, regardless of cause, or for any damage resulting therefrom.

In no event will McGraw Hill or its licensors be liable for any indirect, special or consequential damages, including but not limited to, lost time, lost money, lost profits or good will, whether in contract, tort, strict liability or otherwise, and whether or not such damages are foreseen or unforeseen with respect to any use of the McGraw Hill Content.
